Position Title: Senior Assistant General Counsel - Construction - Louisville, KY

Position Description: 
Performs general and specialized legal services in areas of legal specialization including, but not limited to, construction, contracts, procurement, and public sector governance. Provides management of the Regulatory/Real Estate Department staff including assigning work, performance management and corrective action

Duties/Responsibilities: 
Provides day-to-day management of the Regulatory/Real Estate Department including assigning work, performance management, and corrective action. Assists the Deputy General Counsel in providing advice to senior management on a broad spectrum of legal issues/matters in multiple areas of law including construction, procurement and contracts law. Evaluates and negotiates construction claims from contractors including, but not limited to, delay and/or disruption, differing site conditions, mechanics lien, design/construction defect, and changed work claims. Drafts, amends, and reviews professional services and construction services contracts including design/build contracts. Assists in drafting, preparing, reviewing, negotiating and/or approving other legal documents and policies. Evaluates and assists in selection of project delivery systems and methods for construction projects and serves as a member of the selection procurement team. Negotiates settlement of bond claims of defaulting contractors. Prepares for and appears at mediations and administrative hearings. When necessary and as requested, interfaces with the Executive Director and MSD Board concerning pending claims and/or litigation. Provides advice and counsel to Supplier Diversity staff concerning MBE/WBE compliance and enforcement of MSD's Supplier Diversity Policy. Reviews written internal procurement determinations, Requests for Proposals (RFP), Requests for Bids (RFB) and Requests for Qualifications (RFQ), to ensure compliance with MSD Procurement Regulations and KY Model Procurement Code. Represents MSD in bid protests. Assists in managing departmental budgets. Assists in providing oversight to outside attorneys/firms and other professional contractors and consultants. Communicates and interacts effectively with ratepayers and external governmental and business contacts. Serves on various internal committees. Attends MSD Board and Committee meetings. Attends and represents MSD in public meetings. Performs other duties as assigned. Reports to the Deputy General Counsel.

Education/Experience/Skills Required: 
KNOWLEDGE, SKILLS AND ABILITIES NECESSARY TO THE WORK:
Knowledge of construction, contracts, procurement, public sector governance, civil litigation(including appellate), and administrative procedures; skill in interpreting federal, state, and local laws, rules and regulations, and evaluating novel issues and/or matters; skill in the use of legal research programs; skill in oral and written communications; skill in negotiating; ability to analyze issues, formulate and evaluate alternatives and make sound, decisive recommendations; ability to supervise a diverse workforce; ability to delegate work effectively; ability to operate a PC and associated Windows environment software (Microsoft Office Suite, etc.); ability to exercise judgment and discretion; ability to maintain confidentiality.

MINIMUM REQUIREMENTS:
Bachelor Degree and Juris Doctor Degree required. Must possess six (6) or more years of full-time and progressively responsible experience practicing law. Experience with practicing contracts, procurement, construction, and/or public sector governance law preferred. Public sector or public utility legal experience preferred. Management experience preferred. Must be admitted to the Kentucky Bar Association and possess a current KBA membership in good standing; individuals licensed in another state must be eligible and admitted to practice law in Kentucky within six months of employment. Must possess a valid driver's license. Must have safe work and driving habits.

Salary: 
$95,950.40 - $154,814.40 Annually
