Session A Topic:  Nonprofit Solicitation Registration - A Guide for Compliance

Speaker:  Kathleen M. Venker, Director of Registrations, Nonprofit Service Group

Synopsis:

Nonprofit organizations have a legal obligation to register in every state where the organization
solicits donations. 40 states, including the District of Columbia, require nonprofits to register. Every
state has its own laws, rules and regulations. What classifies as solicitation? What if a charity does not
receive any donations in a state? What are the legal repercussions of not registering? Many nonprofits
are unaware of these laws or decide to ignore. However, nonprofits are at risk of fines and penalties for
not being in compliance.

In this session, participants will learn all the requirements for nonprofit solicitation registration,
specifically what types of charities are required to register and how the various state laws differ. We
will also take a look at IRS requirements for nonprofits when it comes to nonprofit fundraising
registration and issues that arise for nonprofits that fail to comply. In today’s world, there is special
emphasis on online fundraising and how the state jurisdictions are trying to regulate social media and
website donations. We will take a look at how this impacts charities and what it can mean for the future
of nonprofit regulation.
