Family Law and Rule of Professional Responsibility 3.1
 
Join Hon. Frank Birchak for a presentation that will focus in depth on Rule 3.1 (Former Rule 3-200) as it applies specifically in the family law context. This is the Rule that prohibits lawyers from presenting “a claim or defense in litigation that is not warranted under existing law, unless it can be supported by a good faith argument for an extension, modification, or reversal of the existing law.” Family law attorneys face considerable pressure from clients to argue things that are contrary to law because the issues are so emotionally charged. This presentation will present concrete examples of ways this occurs in family law cases, and some suggestions on how to reconcile attorneys’ ethical obligations and clients’ demands. It will also include a discussion of some recent changes to related rules (1.4, 3.3(a)(2), & 3.3(d)) and how those changes alter ethical obligations—even though the language between Rule 3.1 and Former Rule 3-200 did not change significantly
