Welcome to the Facility Asset Renewal Marketplace (“FARM”), a platform hosted by the Rocky Mountain Water Environment Association (“RMWEA”) and developed in partnership with South Platte Renew (“SPR”). By accessing or using the FARM platform, you agree to the following Terms of Use. If you do not agree, please do not use this platform.

1. Purpose of FARM

FARM is a free, classified-ads-style tool designed to allow utilities and water/wastewater professionals to list and browse surplus water and wastewater assets. FARM is intended to facilitate connection between buyer and seller only —no financial transactions are conducted or processed through the platform.

2. No Transactions or Endorsements

RMWEA, SPR, and the FARM platform:

• Do not facilitate, mediate, or participate in any transactions or exchanges of money, goods, or services.
• Do not validate, endorse, or guarantee the quality, availability, legality, or condition of any listed item.
• Are not responsible for the accuracy or reliability of listings or user-submitted content.

3. User Responsibilities

By using FARM, you agree to:

• Confirm that you are at least 18 years old, and if applicable, authorized to act on behalf of your organization or utility.
• Post only accurate, lawful, and non-confidential information.
• Avoid posting spam, misleading, offensive, or infringing content.
• Refrain from discriminatory conduct. Users must not post, share, or communicate any content that discriminates against, harass, or disparages others on the basis of race, color, national origin, ancestry, sex, sexual orientation, gender identify, religion, disability, age, or any other status protected by federal, state or local law.
• Assume full responsibility for any communication, negotiation, or transaction with other users.

We reserve the right to remove any content or restrict access to users who violate these terms.

4. Privacy and Data Use

FARM may collect limited user information (e.g. contact details) for the purpose of facilitating listings. RMWEA and/or SPR will not sell or share data with third parties without consent.

5. Limitation of Liability

To the fullest extent permitted by law:

• RMWEA, SPR, and their officers, employees, and affiliates disclaim all liability for any loss, damage, injury, or claim arising from use of the FARM platform.
• The FARM platform is provided on an “as-is” and “as-available” basis without warranties of any kind.
• Use of the platform is at your own risk.

6. Intellectual Property

All FARM platform materials, including design, logos, and layout, are the property of RMWEA and/or SPR and may not be copied, distributed, or republished without express written permission.

7. Modifications

RMWEA reserves the right to update or modify these Terms of Use at any time. Updates will be posted on this page with the “Effective Date” noted above. Continued use of FARM after changes are posted constitutes acceptance of those changes.

8. Governing Law

These Terms are governed by the laws of the State of Colorado. Any legal disputes arising out of use of the FARM platform shall be resolved in the courts of competent jurisdiction within Colorado. In the event of a dispute arising from use of the FARM platform, users agree to attempt resolution through informal negotiation before pursuing legal remedies.
